Abstract:

This collection contains a brief series of files concerning the Chrysler/General Motors bankruptcy case of 2009. The series includes a number of files of motions during the proceedings, as well as both paper and audio transcripts of the first three days of hearings.

The General Motors reorganization and bankruptcy case occurred in 2009 and involved the sale of the assets of automobile manufacturer General Motors and some of its subsidiaries through section 363 of Chapter 11, Title 11 of the United States Code in the US Bankruptcy Court for the Southern District of New York. This event occurred in the wake of the 2008-2009 US automotive industry crisis, which weakened the American automobile manufacturing industry due to price increases in fuels and car design issues.

Prior to the automotive crisis, GM had for several years been in a financial downturn, projecting by late 2008 that it would run out of cash by mid-2009 without government support, sale of assets, or a merger. Chapter 11 bankruptcy was eventually decided upon as the most viable course of action for GM. Filing and hearings began on 1 June 2009 and concluded in July. On 10 July 2009 a new entity emerged out of the bankruptcy process and completed the purchase of GM's continuing operations, assets, and trademarks as part of the Chapter 11 reorganization. GM's bankruptcy is one of the largest corporate Chapter 11 cases in US history, reporting $82 billion in assets and $172 billion in debt.

This collection is a brief snapshot in history of this monumentous process and bankruptcy event, including some fo the motions and requests filed during the initial stages of the bankruptcy, as well as text and audio transcripts of from the hearings during the case.

This is a brief collection of files and papers concerning the 2009 Chrysler/General Motors bankruptcy case. The files are split into the following series: Motions for Certification, Motions for Formation, Request for the Formation of Additional Committee, First Day Motions, and Hearings Day 1-3.

Motions for Certification contains a transcript of the hearing motion to allow direct appeal of the bankruptcy case to the Second Circuit Court.

Motion for Formation contains a transcript of the hearing motion for final approval of DIP financing and formation of committees in the General Motors bankruptcy case.

Request for the Formation of Additional Committee contians a transcript of the hearing motion to appoint an official committee of family and dissident bondholders in the GM bankruptcy case.

First Day Motions contains a transcript of the motions and observations from the first day of the GM bankruptcy case.

Hearings Day 1-3 each contain the complete transcript of hearings and testimony from the first three days of hearings in the GM bankruptcy case, spanning from 30 June 2009 to 2 July 2009.

Finally, Audio files contains two discs with what seems to be complete audio recordings of all the preceding files in the collection, totalling over 100 hours of recorded hearings, motions, and testimony.
